Most people think only the elderly or wealthy need a will. Many are surprised that young families with very few assets should have a will for one important reason: choosing a guardian for your children. Texas allows you to choose the guardian of your children in your will, giving you the freedom to choose your children’s future. While it is not guaranteed your appointed candidates will be your children’s guardian (they may be disqualified for various legal reasons), but if they are suitable, the court will give preference to your choice over other candidates. If you want to plan for your young children’s future, consult an attorney about creating a will that appoints a guardian.
