Having a special needs child will change one’s life and perspective. We are fortunate to have an enormous amount of support for those with special needs, but it is important to properly plan to assist these wonderful people. The major pitfall for parents planning for their child’s future is leaving their child too much property, disqualifying them from any public assistance. There is a planning tool to prevent this disqualification: Supplemental Needs Trust. A supplemental needs trust is used to maintain and receive assistance while at the same time allowing your child to enjoy his or her life in the way they want, and the way you, as the parent, wishes. The property in the trust may not be counted against your child, allowing you to give property to the child as you wish. If you would like to give the most to your special needs child, please consult your attorney about supplemental needs trusts.
